German construction law is customarily subdivided into private construction law and public construction law.

Private construction law includes civil law provisions upon whose build-to-order contracts for planning, preparation and execution of construction projects are concluded as well as legal standards affecting real property and the rights of adjoining property owners.

Public construction law is that designated part of public law that includes construction planning law and building ordinance law. Construction planning laws (Construction Code = BauGB), Construction Use Ordinance = BauNVO) govern the suitability of land for construction and the Construction Ordinance Act governs requirements on the land and its improvements (state construction ordinances) as, for example, rules governing setback, development, parking places, safety requirements, fire protection, structural integrity and design.
