2. Explosion damages

Successful defense of claims brought for an explosion of a bio-gas plant. During the trial it was shown that the theory of the plaintiff’s private expert witness was inconsistent with physics and motor technology.

Defense of claims arising from a deflagration (low-speed detonation) and delayed fire. The fire was allegedly caused by the use of small containers of a cleaning agent.

 

3. Architects’ law

Defense of claims arising under the architect’s duties as construction supervisor. After the architect reported concerns, the claims relating to it could be successfully defeated.

 

4. Hydraulic engineering

Advised on a major project (slipway closing at the Vulkan shipyard in Bremen)

6. Product liability

Successful defense of damage claims from delivery of allegedly defective seals. During the litigation, we were able to demonstrate that there was no basis for the claims under the Product Liability Act. In addition, the prerequisites for recourse (3d party liability) claims in the supply chain were lacking.

Drafted framework contracts, non-disclosure agreements and quality assurance agreement for a cable manufacturer.

 

8. Insurance law

Successful defense of claims assserted under the German Expanded Model of Product Liability Insurance (Erweitertes Produktemodell), here replacement costs. In the specific case the damaged parts (supplied by the building owner) did not fall within insurance coverage of the Product Liability Insurance since they were part of the insured’s own performance.
